2025 General Terms and Conditions & Participant Waiver (Ireland)

These GTC form part of the binding legal agreement between the Organiser and the Participant, for participation in the Event. These GTC apply upon the Participant's registration and are governed by Irish law.

1. DEFINITIONS

Organiser: Aimwell Events Limited, a private company limited by shares registered in Ireland.
Participant: an adult participant aged 18 or over who registers for the Event via an Entry Form.
Entry Form: the online or paper registration form that must be completed before participation.
Event: the specific obstacle race, as set out above including all the Activities.
Activities: include all warm-up exercises, competitive racing involving natural and artificial obstacles (such as climbing, crawling, jumping, swinging, carrying, water crossings, mud pits, and wall climbs), practice runs, training, use of obstacles or facilities, and all travel related to the Event.
Party or Parties: the Organiser and the Participant, individually or together.

2. CONTRACTUAL BASIS

2.1 A contract is formed only when the Organiser confirms the Participant's registration. Any published information is not a binding offer but an invitation to treat.
2.2 Third-Party Services: Where the Event includes optional third-party offerings (e.g., photography, accommodation, gear hire), the Organiser is not responsible unless it directly provides or contracts those services.
2.3 Payments: Payment processing is managed by a third-party provider. The Participant's registration is only valid once payment is received and confirmed.
2.4 Right to Exclude: The Organiser may exclude Participants for valid reasons including breach of terms, rule violations, safety concerns, or failure to meet physical or health criteria.

3. RULES, CONDITIONS & APPLICABLE DOCUMENTS

The Participant agrees to comply with the following:
  • Event rules published on the Event website;
  • The Course Safety Guide and Athlete Briefing;
  • Any applicable anti-doping policy (such as Sport Ireland standards); and
  • Irish road safety and public event laws (e.g. Road Traffic Acts 1961–2024).
These materials may be updated for safety or regulatory compliance. The Organiser will notify Participants of material changes, and such updates will apply only if necessary, lawful, or clearly in the Organiser's interest.

4. FITNESS, HEALTH & ELIGIBILITY TO PARTICIPATE

4.1 It is the Participant's sole responsibility to ensure they are medically fit for the Activities. By entering, they confirm:
  • They have consulted a doctor if unsure about their health; and
  • They are not aware of any condition making participation unsafe.
4.2 Pregnant Participants must present written medical consent dated no more than 10 days before the Event. Participation without this document may be refused.
4.3 Participants with medical conditions must carry relevant emergency information (e.g., medication, allergy alerts).

5. RISKS AND RISK WARNING (CIVIL LIABILITY ACT 1961)

Obstacle racing is a high-risk activity. By signing this agreement, the Participant:
  • Accepts the risks of injury, illness, disability, or death; and
  • Agrees the risks include but are not limited to:
5.1 Physical Risks:
  • Injury from climbing, crawling, carrying heavy objects, exposure to cold or submerged environments, fatigue, dehydration, impact injuries; and
  • Trips, falls, collisions with other participants, falling from obstacles, water-based injuries (e.g. cold-water shock)
5.2 Environmental Risks:
  • Exposure to uneven ground, rocks, slippery surfaces, sharp objects, barbed wire, high walls, mud pits, fire or ice elements
  • Extreme or unpredictable weather (heatstroke, hypothermia)
5.3 Equipment Risks:
  • Misuse or failure of provided gear (e.g., gloves, shoes, harnesses)
  • Personal protective equipment may mitigate but not remove risk
5.4 Delayed Medical Aid:
  • Due to the outdoor and sometimes remote location of obstacle racing, medical help may be delayed.
This Clause 5 constitutes a formal "risk warning" under Irish law and waives all claims against the Organiser unless caused by gross negligence or breach of statutory duty.

6. LIABILITY & INDEMNITY

6.1 The Organiser excludes liability for negligence to the extent permitted by law. Liability remains in place where required under Irish consumer law or where personal injury arises from proven negligence.
6.2 Participants agree to indemnify and hold harmless Aimwell Events Limited, its directors, staff, volunteers, sponsors, venue providers, and affiliated contractors from claims, losses, or damages arising out of:
  • Breach of these terms;
  • Misconduct or unsafe actions; and/or
  • Failure to follow safety instructions.

7. EQUIPMENT INSPECTION AND CONDUCT

  • The Organiser may inspect participant gear (e.g., shoes, hydration packs) for safety.
  • Use of electronic or mechanical performance-enhancing devices is prohibited.
  • Participants must comply with all verbal or written instructions from marshals and medical teams.

8. MEDIA AND INTELLECTUAL PROPERTY

8.1 By participating, the Participant consents to the use of their image, name, voice, race number, and other likenesses in photos, videos, broadcasts, and promotional materials without compensation.
8.2 The Participant may not use the name, logo, or any branding of Aimwell Events Limited without written permission.

9. WITHDRAWAL, DISQUALIFICATION & TRANSFERS

  • Withdrawals are subject to the Event’s refund and deferral policy.
  • Entries are non-transferable unless authorised in writing.
  • The Organiser may disqualify or remove Participants for breach of terms or unsafe conduct.

10. FORCE MAJEURE & CANCELLATION

10.1 The Organiser may cancel, postpone, or modify the Event due to circumstances beyond its control, including:
  • Natural disasters;
  • Public health emergencies;
  • Police or government orders; and/or
  • Unsafe weather or course conditions.
10.2 If the Event proceeds in altered form, no refund is due. If fully cancelled, a refund or deferral will be offered per the published policy.

11. DATA PROTECTION & MEDICAL CONSENT

All data is handled per the Data Protection Act 2018 and GDPR.
  • Personal and health data may be shared with medical personnel and insurers.
  • Participant data may be retained and used for operational, safety, or legal purposes.
  • Biometric analysis (e.g., for photography) will only occur with express opt-in consent.

12. FINAL TERMS

  • This document is governed by Irish law.
  • Disputes shall be subject to the exclusive jurisdiction of the Irish courts.
  • If any provision is invalid, the rest remain effective.
  • This agreement overrides all other forms unless issued by the Organiser.
